Legal – Unratified Treaties

In October 3, 2005, Organization of American States (OAS) held a two-day meeting “aimed at developing steps to prevent and combat illicit arms trafficking in the Western Hemisphere,” per press release from the U. S. Department of State. The meeting led by a delegate from Colombia,- held in accordance with the OAS ‘Inter-American Convention Against the Illicit Manufacturing and Trafficking in Firearms, Ammunition, Explosives, and Other Related Materials.”

The Colombia delegate called the “convention”- a groundbreaking and unique as it is the First Binding legal agreement on this issue.

The OAS treaty was first proposed in 1998, during the Clinton Administration,-since then, State Department been pushing for Senate ratification of the proposed treaty.  However, the Foreign Relations Committee has never taken it up.  To bypass the Senate’s stalling, OAS retitled the proposed treaty as a “convention,” which doesn’t require Senate approval.  The press release, states, “the entry into force in 1998 of the Inter-American convention against illicit arms trafficking made the OAS a leader in multilateral efforts to address the problem of illicit weapons trafficking.”

How does the U.N. and the none government organizations’ (NGO) skirts the United States Constitution?  They just merely make the United States a “signatory“  to  a “convention” instead.

So now we have treaties that don’t require Senate ratification.  So much for checks and balances.

Arrogance

In the news there has been allot of media regarding Kerry’s insults toward the men and women in uniform over in Iraq.  In every century has its’ arrogant politicians and ours  not different.

In Art. 6 of the U. S. Constitution guarantees the members of Congress may not be sued for slander or libel as a result of anything said while on the floor of Congress, or before committees, or other agencies of Congress.

However, these so-called politicians believes this immunity even extends into the public arena, and one just has to watch the news during an election year-even beyond that.

Well  Sent. Kerry ever be sued for his colorful remarks towards this nation’s finest-  trained and yes,  educated men and women wearing the uniform.

Armed Citizens

It was like a scene from a movie.  Immediately after Char Johannessen and her 5-year-old daughter left their Reno home Wednesday afternoon, her husband was roused from his afternoon nap by their dog barking outside.  Reflected in the glass of a framed picture, Jeffrey Johannessen could see a man outside the dining room window, adorned with a Halloween picture drawn by his daughter. He watched the black-gloved burglar as he pried at the window with a paint scraper. Johannessen, who was a deputy in Gillette, Wyo., in the 1980’s grabbed his 12-guage shotgun from a nearby closet and waited for the  suspect he nicknamed “Cool Hand Luke’ for his criminal confidence.  The burglar, whom police indentified as Ernest Carpenter, never knew Johnannessen was in the home until he faced the shotgun and was told to hit the floor.  After a few blows from the soft end of the but of the shotgun- one strike causing his dentures to fly out- Johannesssen held the suspect untill the police arrived.  ”Having armed populace is good,” Johannessen said. “I had my shotgun, but I didn’t have to fire it. He got the soft end of it, not the business end.”  Carpenter was paroled in Sept. after serving prison for being a felon who possessed a firearm and stolen property in Douglas County, records show. Carpenter was booked Wed. into the Washoe County Jail on suspicion of burglary and possession of burglary tools, as well as two misdemeanor warrants.  Police said that Carpenter was being monitored by the regional Repeat Offender Program that secretly watches career criminals who average at least five felony property crime convictions.
